Notice Instructions - Rule 96

NEW FACILITY

Statewide Rule 96 of the Railroad Commission of Texas requires you to mail or deliver a copy of the application to: each mineral interest owner of the proposed gas storage reservoir; each leaseholder of minerals lying above or below the proposed gas storage reservoir; each leaseholder of minerals offsetting the proposed gas storage reservoir; each owner or leaseholder of any portion of the surface overlying the proposed gas storage reservoir; the clerk of the county or counties where the gas storage reservoir is proposed to be located; and, where the gas storage reservoir is proposed to be located within the limits of a city, the city clerk or other appropriate city official. The copy of the application must be mailed or delivered on or before the date the application is mailed to or filed with the Commission.

In addition, notice in the attached form must be published once a week for three consecutive weeks, at your expense, in a newspaper of general circulation for each county in which the gas storage reservoir is proposed to be located. You must furnish to the Commission a clipping of the published notice, plus a sworn affidavit from the newspaper that the newspaper is of generation circulation in the applicable county. It is recommended that the attached affidavit of publication form be used for this purpose.

AMENDMENT TO AN EXISTING PERMIT

The copy of the application must be mailed or delivered on or before the date the application is mailed to or filed with the Commission.
